  2. Yes, the biggest issue is even if you were to remove all the possible people who could’ve caused the past incidents, the workplace itself *creates* the situation.

    The company *is* the problem.

    That item you mentioned is what bothers me about the contract from a ‘is this real’ context. The issue is something called “Negligent Supervision”, explained [here](https://www.legalmatch.com/law-library/article/negligent-supervision-lawyers.html). That provision seems to be trying to front run that by saying ‘Nuh uh, we specifically said that you can’t use that!’. Generally speaking, contract provisions that go against the actual law are unenforceable. Its a waste of ink to even print that.

    Maybe there is no legal precedent like Negligent Supervision in Japan and its a standard clause over there. Thats all I can think as to why thats in there.

    What amazes me is the clause that allows amending the contract at any time by Niji in combination with compulsion by Niji to get the livers to engage in social media. Technically they could amend the contract, force the liver to interact on social media (accepting the amendments de facto) and if they refused could justify them as refusing to fulfill their duties and terminate them. Basically they could amend the contract at any time and anyone who refused the amendments would have to pay the termination fee.

    That’s not unexpected. Sadly, such contracts are not unusual for entertainment industry. As one man from from record label said “You give band money when there are no other things you can spend money on”.
